Spanish Car Seat Law on the Costa del Sol

Spain’s child car seat law is Artículo 117 del Real Decreto 1428/2003 (DGT). Children under 135 cm must use an approved child restraint (silla de retención infantil, SRI) in all vehicles. For taxis, a partial urban exemption applies for short journeys within city limits — but this does NOT cover airport transfers or Costa del Sol motorway journeys:

• Airport transfers (AGP on the A-7): the A-7 motorway connecting AGP to Málaga city and the Costa del Sol resorts is an interurban road. The taxi urban exemption does NOT apply. Car seat legally required for all children under 135 cm.

• Motorway journeys (Marbella, Nerja, Benalmádena via A-7/AP-7): all require a child seat. Fine: €200 per violation. The DGT carries out spot checks on the A-7 throughout the year.

• Uber: operates as VTC in Málaga city. VTCs are NOT covered by the urban taxi exemption and must carry seats for children under 135 cm. Standard Uber drivers in Málaga rarely carry seats. Uber does not operate along the Costa del Sol outside Málaga city.

• September 2024: new seats sold in Spain must comply with ECE R129 (i-Size). ECE R44/04 seats in use remain legal.

Málaga Costa del Sol Airport (AGP) — What Families Need to Know

Málaga-Costa del Sol Airport (IATA: AGP) is Spain’s fourth-busiest airport, handling over 20 million passengers per year, and the main gateway for the entire Costa del Sol. It is located 8 km southwest of Málaga city centre and 5 km north of Torremolinos. Single terminal (T3, the only active terminal).

• Taxi rank: directly outside the Arrivals exit. Málaga taxis are white with a blue stripe (distinctive livery). Only use taxis with the official blue stripe and a running taximeter. No official flat rate from AGP — all metered.

• Bus (Autobuses de la Junta de Andalucía): Line A-75 connects AGP to Málaga city centre in approximately 25–30 minutes for €3. No car seat. Not suitable for families with infant carriers and suitcases.

• Train (Cercanías C-1): AGP railway station is a 5-minute walk. Trains to Málaga Centro-Alameda in 12 minutes for €1.80. Excellent for adults. No car seat — impractical for families with luggage.

Transfer Fares from AGP — Costa del Sol in EUR

AGP → Benalmádena (Puerto Marina, Selwo Marina, Sea Life)

Approximately €25–38 (12―15 km, 15–22 min via A-7). Benalmádena has the Puerto Marina, Selwo Marina park, and the Sea Life aquarium. Very popular with families with young children.

AGP → Fuengirola (Bioparc, long sandy beach)

Approximately €35―48 (28–32 km, 28―40 min via A-7). Fuengirola Bioparc is one of the best zoos on the Costa del Sol. Long sandy beach and a relaxed family atmosphere.

AGP → Marbella (Old Town, Puerto Banús)

Approximately €65–78 (65–70 km, 50–65 min via AP-7 toll motorway). Marbella is the luxury resort capital of the Costa del Sol. Puerto Banús marina, the Marbella Old Town, and excellent beaches. AP-7 toll applies — confirm inclusion in fixed price. Uber does not operate in Marbella.

AGP → Nerja (caves, balcón de Europa)

Approximately €60–75 (55―60 km east via A-7, 50–60 min). Nerja is the most popular destination east of Málaga: the Nerja Caves, the Balcón de Europa clifftop, and charming beaches. Pre-book with fixed price for this distance.

AGP → Estepona

Approximately €80–105 (90―95 km west via AP-7, 65–80 min). Quieter resort west of Marbella with a preserved old town and excellent beaches. AP-7 toll applies.

Car Seat Types Available for Costa del Sol Transfers

All seats meet ECE R44/04 or ECE R129 (i-Size). Spanish law threshold: 135 cm. Provide weight and height when booking.

• Capazo (rear-facing, up to 13 kg): birth to approx. 12–15 months. Required on all A-7/AP-7 motorway transfers. AGP rank taxis carry none. Pre-booking essential.

• Silla infantil with harness (9–18 kg): approx. 9 months to 4 years. Required on all interurban transfers on the Costa del Sol.

Do Málaga taxis have child car seats?

Almost never as standard. Spanish law (Art. 117 RD 1428/2003) gives licensed taxis a partial exemption for short journeys within city limits. How do I recognise a legitimate Málaga taxi?

Málaga’s licensed taxis have a distinctive livery: white body with a blue diagonal stripe on the front doors, plus an illuminated “TAXI” sign on the roof. Always use a taxi with a running taximeter that displays the starting fare (called “bajada de bandera”). Avoid private drivers who approach you inside the terminal.

Is Uber available on the Costa del Sol?

Uber operates in Málaga city as a VTC (private hire vehicle), but does not operate in Marbella, Torremolinos, Benalmádena, Fuengirola, Nerja, or most Costa del Sol resorts.
